On Monday, the Supreme Court ruled that Nikita Singhania, the estranged wife of Bengaluru techie Atul Subhash, who is accused of aiding and abetting his suicide, and her family will continue to have custody of the young boy of the techie who committed suicide.
This ruling came after a bench of Justices B V Nagarathna and S C Sharma rejected Anju Devi, Subhash’s mother,’s motion to be given custody of the child.
Justice Nagarathna stated during a hearing on January 7 that Anju Devi was “almost a stranger to the child,” suggesting that they were unfamiliar with one another.
The child is reportedly attending a boarding school in Haryana, and the court wished to speak with them. Additionally, it asked Singhania and the Haryana government to provide affidavits regarding the child’s condition.
Anju Devi’s attorney requested more time in the case on Monday, but the court denied it and spoke with the youngster privately online.
Anju Devi argued that youngsters of that age shouldn’t be sent to a boarding school and asked the court to give her custody of her grandson. She brought forward the claims that Singhania was involved in Subhash’s demise. The court did state, however, that Singhania had not yet been proven guilty and that inferences about the case cannot be made from media coverage.
Allegations in Atul Subhash’s death note
On December 9, 2024, Atul Subhash, a native of Uttar Pradesh who lived in Munnekollal in southeast Bengaluru, was discovered dead in his apartment. In 2019, he wed Nikita Singhania, who works in software as well, but the two have since split up.
He left behind an 81-minute video and a 24-page message accusing his estranged wife and her relatives of harassing him before he passed away. In addition to being charged with dowry harassment, unnatural sex, and attempted murder, Subhash was also facing nine other cases, some of which named his parents as defendants. He also claimed in his death note that his in-laws were being favored by an Uttar Pradesh family court judge.
The Marathahalli police booked Nikita Singhania, her mother Nisha Singhania, brother Anurag Singhania, and uncle Sushil Singhania for aiding and abetting suicide after his brother Bikas Kumar filed a complaint against them. They are alleged to have demanded Rs 30 lakh for the right to meet his son and Rs 3 crore to get the cases against Subhash withdrawn.
On December 15, Nikita Singhania was taken into custody in Gurugram, Haryana, while her brother and mother were taken into custody in Allahabad, Uttar Pradesh. On January 4, the three were granted bail by a Bengaluru civil and sessions court.
