After at least three kids fell from the children’s amusement ride earlier in the day, the Vadodara city police on Wednesday charged the kid’s ride operator and the Royal Mela organizer and management with negligence and endangering the personal safety of others.
According to the police, the City Ride Safety and Inspection Committee, which was established to carry out the Gujarat Amusement Rides and Gaming Zone Activities Safety Rules, started interviewing the three defendants on Thursday in order to compile its inspection report.
The FIR was filed at Raopura police station against the organiser, and fair’s manager, and operator of the ride shortly before midnight based on the complaint of Jayesh Bhaliya, a resident of Vadodara, whose four-year-old son was among the children who fell from the ride. In his complaint, Bhaliya said that once the operator engaged the levers, the ride’s speed abruptly rose following the first three rotations.
Bhaliya said in the complaint, “At that moment, suddenly the door of the cabin that my son was sitting in, opened and my son was dangling on the side. A child from another cabin on the helicopter ride also fell out as the second door opened… I immediately pulled out my child from the ride but before I could reach out for the other child, panic had ensued and the operator escaped without turning off the ride”.
According to him, someone else took out the ride’s cables to stop it and prevent an accident. FIR states, “While I moved to turn off the switch, another man pulled the cable out from under the base, bringing the ride to a gradual halt. We called the police control room. Although my son did not have any visible injuries, he was extremely scared… The organisers and managers of Royal Mela did not conduct appropriate inspections”.
On Thursday, when Committee members arrived at the Raopura police station, the operator Yunus Mohammad, the fair manager Hemraj More, and the organizer, Nilesh, were taken in for interrogation. Allegedly, the amusement ride was not included on the list of rides authorized.
Deputy Commissioner of Police, J C Kothiya stated, “Once the inspection report is submitted, further action will be decided… The organisers had taken permissions for the fair but the committee has already begun its work on ascertaining which rides were permitted, which were installed, and whether they were fit for certification”.
On the basis of the Inspection Committee’s proposal, DCP Kothiya further stated that the police will think about calling upon additional Bharatiya Nyaya Sanhita (BNS) sections.
The suspects have been charged under BNS sections 289 (negligent behavior with regard to machinery) and 125 (act endangering life or personal safety of others).
